These Terms and Conditions govern your use of the Black Girl Moments merch store at merch.blackgirlmoments.com and all purchases made through it. By browsing the store, creating an account, or completing a purchase, you agree to be bound by these Terms. Please read them carefully before placing an order.

1. About the Store

Black Girl Moments Merch is an online retail store selling apparel, accessories, home goods, and digital printables celebrating Black women’s culture, faith, and identity. The store is owned and operated by 8x10designs, based in Philadelphia, Pennsylvania, United States.

These Terms apply to all visitors, customers, and account holders. If you do not agree to these Terms, you may not use the store or make purchases.

2. Eligibility

By using the store, you confirm that:

  • You are at least 18 years of age, or you are between 13 and 17 years of age and have obtained verifiable parental or guardian consent to make a purchase
  • You have the legal capacity to enter into a binding agreement
  • You are not located in a jurisdiction where purchasing our products is prohibited by law
  • You will provide accurate, complete, and current information when placing an order

We reserve the right to refuse service to anyone for any lawful reason, including but not limited to suspected fraud or violation of these Terms.

3. Products

3.1 Physical Goods

We sell apparel (hoodies, t-shirts, sweatshirts), accessories (hats, bags, jewelry), and home goods (mugs, candles, and similar items). Physical goods are produced on demand through our fulfillment partners — Printful, Printify, and Gelato — and shipped directly to you.

 

3.2 Digital Downloads

We sell digital printables including affirmation cards, art prints, and graphic designs. Digital products are delivered electronically to your email address immediately after payment is confirmed. No shipping address is required for digital-only orders.

 

3.3 Product Descriptions and Images

We make every effort to display our products accurately, including colors, sizing, and design placement. However:

  • Colors may appear slightly different on your screen depending on your display settings and device calibration
  • Print placement on physical goods may vary slightly from product to product — this is normal for print-on-demand manufacturing
  • Sizing charts are provided as a guide — we recommend measuring yourself and consulting the size chart before ordering, as sizes may vary by product and manufacturer
  • Digital product previews show the design as it will appear in the downloadable file

If a product is significantly different from its description or images, contact us within 14 days of receiving your order and we will work to resolve it.

 

3.4 Product Availability

All products are subject to availability. Because many items are produced on demand, availability is generally continuous. However, we reserve the right to discontinue any product at any time without notice. If a product becomes unavailable after you have placed an order, we will notify you and offer a full refund or a suitable alternative.

4. Pricing and Payment

4.1 Pricing

All prices are displayed in US dollars (USD) unless otherwise indicated. Prices are subject to change without notice. The price charged at the time of your order confirmation is the price you will pay — price changes after your order is placed do not affect your transaction.

 

4.2 Taxes

Applicable sales tax will be calculated and added to your order total at checkout based on your shipping address and applicable tax laws. For international orders, customs duties, import taxes, and value-added taxes (VAT) assessed by the destination country are the sole responsibility of the customer. We are not responsible for these charges and cannot predict their amount in advance.

IMPORTANT: International customers: customs duties and import taxes are not included in the product price or shipping fee. These charges are assessed by your country’s customs authority upon arrival and must be paid by you to receive your package. Refusal to pay customs duties may result in the package being returned or destroyed — in which case a refund will not be issued.

 

4.3 Payment Methods

We accept payment through Stripe, which supports major credit and debit cards including Visa, Mastercard, American Express, and Discover, as well as digital wallets where supported. All payment transactions are encrypted and processed securely by Stripe. We do not store your full payment card details on our servers.

 

4.4 Order Confirmation

After you complete checkout, you will receive an order confirmation email at the email address you provided. This confirmation is acknowledgment that we have received your order — it is not an acceptance of the order. We reserve the right to cancel any order after confirmation if we suspect fraud, if the product is unavailable, or if there is a pricing error.

 

4.5 Pricing Errors

In the event that a product is listed at an incorrect price due to a typographical error or system error, we reserve the right to cancel orders placed at the incorrect price, even after order confirmation. We will notify you promptly and issue a full refund if your order is cancelled for this reason.

5. Shipping and Delivery

 

5.1 Fulfillment Partners

Physical orders are produced and shipped by one or more of the following print-on-demand fulfillment partners depending on the product and your location:

  • Printful, Inc.
  • Printify, Inc.
  • Gelato AS

Each partner operates production facilities in multiple countries and will route your order to the facility best positioned to serve your location efficiently.

 

5.2 Production Time

Because our physical products are made to order, there is a production period before your item ships. Standard production time is 2–7 business days depending on the product type and the fulfillment partner. Production time is separate from and in addition to shipping transit time.

 

5.3 Shipping Times

Estimated shipping times after production is complete:

  • United States: 3–7 business days standard, 1–3 business days expedited where available
  • Canada: 5–10 business days
  • United Kingdom and Europe: 5–10 business days
  • Australia and New Zealand: 7–14 business days
  • Rest of World: 10–20 business days

These are estimates only. Actual delivery times may vary due to carrier delays, customs processing, weather, holidays, or other circumstances beyond our control. We are not responsible for delays caused by shipping carriers or customs authorities.

 

5.4 Shipping Costs

Shipping costs are calculated at checkout based on your location, the weight of your order, and the selected shipping method. Shipping costs are non-refundable unless the return is due to our error.

 

5.5 Tracking

Once your order ships, you will receive a shipping confirmation email with a tracking number where available. Not all international shipping methods include end-to-end tracking. We are not responsible for packages once they are handed to the carrier.

 

5.6 Undeliverable Packages

If a package is returned to us or our fulfillment partner as undeliverable due to an incorrect address, failed delivery attempts, or refusal of customs duties, we will contact you. You may choose to have the order reshipped at your expense or receive a refund for the product cost only — original shipping fees are non-refundable.

 

5.7 Lost or Stolen Packages

If tracking shows your package as delivered but you have not received it, please first check with neighbors, building management, or your local post office. If the package cannot be located, contact us at support@blackgirlmoments.com within 7 days of the marked delivery date and we will work with the carrier to investigate. We are not responsible for packages confirmed as delivered by the carrier or for packages stolen after delivery.

6. Returns, Exchanges, and Refunds

 

6.1 Physical Goods — Return Policy

Because our physical products are made to order specifically for you, we do not accept returns or exchanges for:

  • Buyer’s remorse or change of mind
  • Incorrect size ordered — please consult the size chart before purchasing
  • Color variations due to screen display differences
  • Minor print placement variations within industry-standard tolerances

We do accept returns and will provide a replacement or refund in the following circumstances:

  • The item arrived damaged or defective
  • The item received is significantly different from what was ordered (wrong design, wrong product type)
  • The item was lost in transit and not delivered

To request a return or replacement for a qualifying issue, contact us at support@blackgirlmoments.com within 14 days of delivery with your order number and clear photos of the issue. We will review your request and respond within 3 business days.

 

6.2 Digital Downloads — Refund Policy

All digital product sales are final. Because digital files are delivered immediately upon purchase and cannot be returned, we do not offer refunds on digital downloads once the file has been delivered.

Exceptions: if you were charged in error, received a duplicate charge, or experienced a verified technical failure that prevented delivery of your file, contact us at support@blackgirlmoments.com within 7 days of purchase and we will review your case and issue a refund if the error is confirmed.

 

6.3 Refund Processing

Approved refunds will be issued to the original payment method through Stripe. Refund processing time is typically 5–10 business days depending on your card issuer or bank. We will notify you by email when a refund has been issued.

 

6.4 Disputes and Chargebacks

We ask that you contact us at support@blackgirlmoments.com before filing a dispute or chargeback with your card issuer. Most issues can be resolved quickly and directly. Chargebacks filed without first contacting us may result in suspension of your account and may delay resolution. We reserve the right to contest chargebacks that we believe are not warranted based on our policies.

7. Cancellations

Because physical orders enter production quickly, our ability to cancel is limited:

  • Orders may be cancelled within 1 hour of placement for a full refund — contact us immediately at support@blackgirlmoments.com if you need to cancel
  • After 1 hour, cancellation is not guaranteed as production may have already begun
  • Orders that have already been sent to production or shipped cannot be cancelled
  • Digital download orders cannot be cancelled once the download link has been delivered

If you contact us within the cancellation window and we are able to cancel your order, a full refund will be issued to your original payment method within 5–10 business days.

8. Promotions and Discount Codes

From time to time we may offer promotional pricing, discount codes, or limited-time sales. The following terms apply to all promotions:

  • Discount codes must be entered at checkout — they cannot be applied retroactively to completed orders
  • One promotional code per customer per transaction unless the promotion explicitly states otherwise
  • Promotions cannot be combined with other offers or discount codes unless explicitly stated
  • Promotional pricing applies only to the specific products or categories stated in the offer
  • Limited-time offers are valid only during the stated promotional period
  • Flash sales and limited-quantity offers are available while supplies or time permits — we cannot guarantee availability
  • Promotional pricing for first-time purchases applies once per customer household
  • We reserve the right to modify, extend, or end any promotion at any time without notice
  • Promotional codes have no cash value and cannot be transferred or sold
  • If a promotional code is applied to an order that is later returned, the refund will reflect the discounted price paid, not the full retail price

9. Intellectual Property

 

9.1 Our Content and Designs

All designs, graphics, logos, taglines, slogans, artwork, and written content available in the Black Girl Moments store are the intellectual property of 8x10designs and Black Girl Moments, or are used under license. This includes but is not limited to all affirmation phrases, cultural artwork, brand marks, and product designs.

All rights are reserved. You may not reproduce, copy, distribute, resell, or create derivative works from any store content or product designs without our express written permission.

 

9.2 Personal Use License — Digital Downloads

When you purchase a digital download from the Black Girl Moments store, you receive a limited, non-exclusive, non-transferable personal use license. This license permits you to:

  • Download and print the file for your own personal use
  • Display printed items in your personal space — home, office, or as a personal gift
  • Share the digital file with immediate family members for personal use

This license does not permit you to:

  • Resell the digital file or printed versions of it
  • Use the design for commercial purposes including on products you sell
  • Distribute the file digitally to others outside of immediate personal family use
  • Upload the design to print-on-demand platforms or stock image sites
  • Remove, alter, or obscure any watermarks or copyright notices
  • Claim the design as your own original work

IMPORTANT: Unauthorized commercial use of our digital designs is a violation of copyright law and these Terms. We actively monitor for unauthorized use and reserve the right to pursue legal remedies.

 

9.3 Physical Product Resale

Physical products purchased from the store may be resold as personal items (for example, selling a hoodie you no longer wear). However, you may not purchase products in bulk for the purpose of reselling them as a business without entering into a separate wholesale or reseller agreement with us. Unauthorized commercial resale of our products in volume is prohibited.

10. User Accounts

You may choose to create an account to save your addresses, view order history, and check out faster. By creating an account, you agree to:

  • Provide accurate and complete registration information
  • Keep your password secure and not share it with others
  • Notify us immediately if you suspect unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms, are associated with fraudulent activity, or have been inactive for an extended period. You may delete your account at any time by contacting us at support@blackgirlmoments.com.

11. Prohibited Uses

You may not use the store for any of the following purposes:

  • Fraudulent transactions or use of stolen payment credentials
  • Placing orders with false, inaccurate, or misleading information
  • Attempting to circumvent or reverse-engineer the store’s security or payment systems
  • Scraping, crawling, or automated data collection from the store without our written permission
  • Using the store to distribute spam, malware, or harmful code
  • Harassing, threatening, or abusing our staff or other customers
  • Purchasing products for unauthorized commercial resale as described in Section 9
  • Any activity that violates applicable local, national, or international law

Violation of these prohibited uses may result in immediate account suspension, cancellation of orders without refund, and where appropriate, referral to law enforcement.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Black Girl Moments and 8x10designs shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages arising from your use of the store or any product purchased
  • Delays or failures in delivery caused by shipping carriers, customs authorities, or circumstances beyond our reasonable control
  • Loss or damage to packages after confirmed delivery by the carrier
  • Damages arising from your failure to follow care instructions for physical products
  • Any issue arising from a third-party service including Stripe, Printful, Printify, Gelato, or any shipping carrier

Our total liability to you for any claim arising from a purchase shall not exceed the amount you paid for the specific product that is the subject of the claim.

13. Disclaimer of Warranties

The store and all products are provided ‘as is’ and ‘as available’ without warranties of any kind, express or implied, except as required by applicable consumer protection law. We do not warrant that the store will be uninterrupted, error-free, or free of viruses or other harmful components.

Nothing in these Terms limits your rights under applicable consumer protection laws that cannot be excluded by contract, including rights relating to defective goods and misrepresentation.

14. International Orders — Legal and Export

Black Girl Moments ships physical goods internationally and sells digital downloads worldwide. The following applies to international customers:

 

14.1 Compliance With Local Laws

You are responsible for ensuring that the products you order are legal to import and use in your country. We make no representation that products available in the store are appropriate or lawful for use in all locations. If you are uncertain whether a product is permitted in your country, please check with your local authorities before ordering.

 

14.2 Export Restrictions

Our products are subject to United States export laws and regulations. By placing an order, you represent that you are not located in, and will not ship products to, any country subject to a comprehensive US embargo, and that you are not on any US government restricted party list. Our products are consumer lifestyle goods and are not subject to specific export control classifications, but general US export laws apply.

 

14.3 Customs and Import Duties

International shipments may be subject to customs inspection, duties, taxes, and fees imposed by the destination country. These charges are entirely the responsibility of the customer and are not included in our product or shipping prices. We are legally required to accurately describe order contents and values on customs documentation — we will not falsify customs declarations or mark shipments as gifts to avoid duties.

 

14.4 Digital Downloads — International

Digital downloads are available to customers worldwide where internet access and digital payment are permitted. There are no shipping or customs considerations for digital products. You are responsible for ensuring that downloading and using our digital files is lawful in your jurisdiction.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania and the United States of America, without regard to conflict of law principles.

 

15.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to contact us at legal@blackgirlmoments.com and attempt to resolve the dispute informally. We will make a good-faith effort to resolve any issue within 30 days of receiving your written notice.

 

15.2 Jurisdiction

If informal resolution is unsuccessful, any legal action or proceeding relating to these Terms or your use of the store shall be brought exclusively in the state or federal courts located in Philadelphia, Pennsylvania. You consent to the personal jurisdiction of those courts.

 

15.3 International Customers

If you are located outside the United States, local consumer protection laws in your country may give you rights that cannot be excluded by these Terms. Nothing in these Terms is intended to limit rights you have under mandatory consumer protection laws in your jurisdiction.

16. Privacy

Your use of the store is also governed by our Privacy Policy, available at https://merch.blackgirlmoments.com/privacy-policy. By using the store, you agree to the collection and use of your information as described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

17. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the ‘Last Updated’ date at the top of this page and post a notice on the store. Your continued use of the store after changes are posted constitutes your acceptance of the updated Terms.

If we make significant changes that materially affect your rights, we will notify registered customers by email at least 14 days before the changes take effect.

18. Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity and enforceability of the remaining provisions.

These Terms, together with our Privacy Policy and any order confirmation, constitute the entire agreement between you and Black Girl Moments with respect to your use of the store and supersede all prior agreements and understandings.
